A IT firm has taken a All risk policy covering laptops given to its employee. A employee was travelling to US for a companys project and lost his laptop.
In the policy the Geographical limit for the coverage was within India. Hence the claim was repudiated.
It was convinced to insurance company that all the material facts were disclosed at the time of taking the policy. The details of subject matter like individual who would be using it, purpose of use during traveling etc. were shared at the time of taking the policy. Finally insurance agreed to give worldwide coverage.
The geographical limit should be worldwide
